TITLE OF BILL:
An act to amend the retirement and social security law, in relation to
the limitation of overtime compensation in final average salary calcu-
lations
 
SUMMARY OF PROVISIONS:
Section 1 amends section 1203 of the Retirement and Social Security Law
to lift the cap on overtime used in the calculation of final average
salary from 15% to 30%.
Section two of the bill provides the effective date.
 
JUSTIFICATION:
Police officers and firefighters have a very unique and dangerous
profession. They face some of the most stressful situations every day
and are often ordered to work overtime for the safety of the residents
they are sworn to protect. This time should be treated the same by the
retirement system as regularly worked hours with respect to pension
benefits. The work is no less stressful or dangerous whether it is
during straight time or overtime. Furthermore, due to the nature of
police and fire officers' jobs, they are often ordered to remain on the
job and are not at liberty to leave of their own accord.
