TITLE OF BILL:
An act to amend section 4 of part C of chapter 57 of the laws of 2024,
amending the education law relating to removing the exemption for school
psychologists to render early intervention services, in relation to the
effectiveness thereof
 
PURPOSE:
To extend authorization for school psychologists to provide early inter-
vention services to June 30, 2026.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 amends section 4 of part C of chapter 57 of the laws of 2024
to extend authorization for school psychologists to provide early inter-
vention services to June 30, 2026.
Section 2 provides the effective date.
 
JUSTIFICATION:
All children aged birth through three with developmental delays and
disabilities have a right to appropriate interventions, known as early
intervention, under federal law.1 This federal mandate recognizes that
when services are available early and on time, young children are more
likely to develop to their full potential, and less likely to need
intensive special education services later in life. Over 40,000 chil-
dren throughout the state are currently provided services as a preschool
child with a disability through New York State approved 4410/preschool
programs and agencies. An additional 8,200 infants from birth through
age 2 are served through the Early Intervention System. School psychol-
ogists are an important part of the provider community serving these
children, but their authorization to provide EI services expires April
1, 2025.
This bill extends authorization for school psychologists to provide EI
services through June 30, 2026.

This act shall take effect immediately.
