SPONSOR: SANDERS
TITLE OF BILL:
An act to amend the executive law, in relation to maternity policies for
police officers and correctional officers
PURPOSE:
To ensure appropriate maternity leave practices for officers and correc-
tional officers.
SUMMARY OF PROVISIONS:
Section 1 amends the executive law by adding a new section 845-c that
states any entity employing a police officer or correctional officer
shall ensure against discrimination on the basis of pregnancy, child
birth or any related medical condition; that they are treated in same
fashion as temporarily disabled officers during pregnancy; that they
provide appropriate modifications to their assignments and take into
consideration any specific restrictions identified by a pregnant offi-
cers' physician; that they exempt officers from firearms qualifications
requirements during pregnancy; and that they provide for all practicable
uniform and/or equipment modifications as may be necessary.
Section 2 of the bill provides that the act shall take effect on the
sixtieth day after it shall have become law.
EXISTING LAW:
New law
JUSTIFICATION:
It is important to set clear guidelines on what officers and corrections
officers can expect while pregnant. They should not have to worry about
a demotion or other loss of benefits during that time. This, in turn,
will help agencies retain and acquire new officers, necessary because of
the crucial service they provide to the residents of this state.
