TITLE OF BILL:
An act to amend the administrative code of the city of New York, in
relation to eligibility requirements for rent increase exemptions for
persons with disabilities
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill relates to eligibility requirements for rent increase
exemptions for persons with disabilities.
 
SUMMARY OF PROVISIONS:
Section 1 subdivision (d) of section 26-601 of the administrative code
of the city of New York, as amended by local number 39 of the city of
New York for the year 2014 is amended to read as follows, "eligible head
of the household" means a person or his or her spouse who is sixty-two
years of age or older, who qualifies as a person with a disability
pursuant to section 26-617 of this chapter and is entitle to the
possession or to the use of a dwelling unit.
Section 2 subdivision (d)of section 26-601 of the administrative code of
the city of New York, as separately amended by local number 75 and 76 of
the city of New York for the year 2005, is amended to read as follows
"eligible head of the household" means a person or his or her spouse who
is sixty-two years of age or older, who qualifies as a person with a
disability pursuant to section 26-617 of this chapter and is entitle to
the possession or to the use of a dwelling unit.
Section 3 this act shall take effect immediately.
 
JUSTIFICATION:
Currently persons with disabilities are not considered head of house-
holds if their name is not on the lease. This legislation would allow
persons with disabilities to be considered as head of households and
allow them to receive cash supplemental security income benefits if they
are the spouse or child of the person on the lease.

EFFECTIVE DATE:
