TITLE OF BILL:
An act to amend the criminal procedure law, in relation to making tech-
nical corrections to the clean slate law to correct issues relating to
multicategory conviction dockets and the conviction-specific supervision
prohibitor
 
PURPOSE:
To amend the criminal procedure law, in relation to making technical
corrections to the clean slate law to correct issues relating to multi-
category conviction dockets and the conviction-specific supervision
prohibitor.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 amends paragraph (b) of subdivision 1 of section 160.57 of the
criminal procedure law, as added by chapter 631 of the laws of 2023
which provides additional specifications regarding the criteria of seal-
ing criminal convictions.
Section 2 provides for the effective date.
 
JUSTIFICATION:
Upon the passage and enactment of the Clean Slate Act (S7551A of "24)
which sought to end the perpetual burden created by a criminal record,
despite completing their debt to society. In its application, however,
it is crucial to amend certain technical language portions to ensure
that it can be implemented effectively.
Due to the technological infrastructure necessary to meet the State's
goal of automatically sealing all eligible convictions by November 16,
2027, certain implementation issues have arisen due to the use of the
term, "conviction". Considering that, the Clean Slate Act requires
offense-specific sealing, this definition would prevent the timely
completion of the statutory mandate due to the limitations of the
programming build being completed by the Unified Court System (UCS)
through their Division of Technology and Court Research. As such, these
amendments will ensure that these hindrances are bypassed allowing for
the timely completion of the statutory mandate.
