PURPOSE:
The purpose of this legislation is to ensure customers of waste removal
services are provided with accurate cost estimates, invoices, and
receipts.
SUMMARY OF SPECIFIC PROVISIONS:
This bill would:
*define "estimated full cost", "full cost", "waste removal services",
and "waste hauler";
*require a waste hauler that performs waste removal services to provide
a customer with:
*the estimated full cost of waste removal services, presented in a range
from lowest to highest amount, including the cost per unit of weight,
prior to the provision of waste removal services;
*an invoice of the full cost of waste removal services after they are
provided;
*an itemized receipt after payment;
*require invoices for waste removal services to reference Section 392-k
of the General Business Law;
*establish a penalty of up to $500 for a first violation of the bill's
requirements and up to $2,500 for subsequent violations; and
*require penalties to be deposited to the credit of the Environmental
Protection Fund.
JUSTIFICATION:
The amendments provided above are vital to creating transparent trans-
actions relating to trash, and/ or junk removal. It is important that
potential patrons looking to responsibly discard of waste are not
subject to potential bad faith deals without recourse or regulation. By
requiring companies to provide a final invoice before the waste removal
project is done, it promotes a level of trust between the company and
the customer that is not always present: Moreover, the immediate imple-
mentation and enforcement of civil penalties will deter predatory compa-
nies from harming vulnerable customers.

EFFECTIVE DATE:
