TITLE OF BILL:
An act to amend the executive law, the state finance law and the public
authorities law, in relation to establishing expanded construction
mentorship opportunities for small and minority and women-owned business
enterprises
PURPOSE:
The purpose of this bill is to create and expand construction mentorship
programs aimed at supporting small businesses and minority and women-
owned business enterprises (MWBEs) by providing them with the necessary
skills and resources to bid on state contracts.
SUMMARY OF SPECIFIC PROVISIONS:
Section 2. Amends paragraph (e) of subdivision 4 of section 311 of the
executive law to identify and establish mentorship opportunities and
other business development programs for MWBEs to better prepare them for
state contracts.
Section 2. Amends paragraph (j) and adds a new paragraph (k) to subdivi-
sion 2-a of section 313 of the executive law, requiring agencies to
consult disparity studies when setting participation goals and encourag-
ing mentor-protege relationships.
Section 3. Amends subdivision 1 of section 147 of the state finance law
to mandate the development of mentor-protege programs in state agencies,
departments, and authorities that let more than ten million dollars in
service and construction contracts annually.
Section 4. Amends subparagraphs (vi) and (vii) of paragraph b of subdi-
vision 2 of section 1265-b of the public authorities law and adds a new
subparagraph (viii) to further establish small business mentoring
programs between the agency and MWBEs.
Section 5. Provides that this act shall take effect immediately, with
specific provisions affecting article 15-A of the executive law and
section 1265-b of the public authorities law.
JUSTIFICATION:
This bill is necessary to support the growth and development of small
and minority and women-owned business enterprises (MWBEs). By providing
mentorship opportunities, the bill aims to increase the capacity of
these businesses to successfully bid on state contracts, thereby promot-
ing diversity and inclusivity in state procurement processes. The
mentorship programs will help bridge the gap between small MWBEs and
larger contractors, ensuring they have the necessary skills and
resources to compete effectively.
