TITLE OF BILL:
An act to amend the transportation law, in relation to requiring bomb or
blast resistant garbage receptacles in facilities of common carriers
 
PURPOSE:
To require bomb resistant garbage receptacles in all transportation
facilities relating to the transportation of passengers or property from
one point to another within the state of New York by any common carrier
performing such service.
 
SUMMARY OF PROVISIONS:
§ 1.Section 113 of the transportation law is added providing that:
1. Every corporation, person or common carrier performing transportation
services regulated under the Transportation Act shall furnish its public
facilities with bomb or blast resistant garbage receptacles.
2. The minimum specifications of the bomb or blast resistant garbage
receptacles shall be determined by the New York State Division of Home-
land Security and Emergency Services.
2. This act shall take effect on the one hundred eightieth day after it
shall have become a law.

JUSTIFICATION:
Since the terrorist attacks of September 11, 2001, our nation and our
state has had to increase measures to protect our citizens against
terrorist attacks. Terrorists have traditionally targeted transit
centers in order to inflict physical harm and massive terror on its
victims. In 2004 a bombing in the Moscow subway killed 41 people and
wounded 120 others, a bombing in the Madrid subway in 2004 killed 191
people and wounded 1,800 others and a bombing in the London subway in
2005 killed 52 people and wounded nearly 700 others.
One way of protecting our citizens from potential bombings in transit
centers is to require the carriers to place bomb or blast resistant
garbage receptacles in transit centers. The use of bomb or blast resist-
ant garbage receptacles will protect against fragments and other materi-
als such as shrapnel, nails and screws commonly used in bombs, secondary
fragments from near the charge including trash contained in receptacles,
blast pressure and fireballs caused by the blast. This bill will mandate
that all common carriers operating in the State of New York place bomb
or blast resistant garbage receptacles in their public facilities to
protect the citizens using those facilities.
