TITLE OF BILL:
An act to amend the agriculture and markets law, in relation to prohib-
iting fractional pricing of certain petroleum products
PURPOSE:
To prohibit retailers from selling motor fuel at a price per gallon that
includes any fraction of a cent.
SUMMARY OF PROVISIONS:
Section 1: Amends Section 192 of the agriculture and markets law by
adding a new subdivision 7 prohibiting retailers from selling or offer-
ing motor fuel at a price per gallon that includes any fraction of a
cent. Failure to comply subjects the seller of said motor fuel to a
civil penalty of up to twenty-five dollars for each day of non-compli-
ance.
Section 2: Amends Subparagraph (iii) of paragraph a of subdivision 5 of
section 192 of the agriculture and markets law, as amended by chapter
101 of the laws of 1986. In cases where a dispensing device can handle
multiple products at different prices, the selling price per gallon may
be posted with numerals at least one-half the height and one-half the
width required for single-price displays. If displayed, numerals repres-
enting tenths of a cent should be no less than one-half the dimensions
disclosing the selling price per gallon.
Section 3: Sets Effective Date.
JUSTIFICATION:
This bill will standardize the display of motor fuel prices at retail,
increasing both price transparency and awareness for New York consumers.
Doing so helps prevent confusion and prohibits a potentially deceptive
pricing practice.

EFFECTIVE DATE:
This act shall take effect on the one hundred-eightieth day after it
shall, become a law. Effective immediately, the commissioner of agricul-
ture and markets is authorized to promulgate any rules and regulations
necessary to implement this act on or before such effective date.
