TITLE OF BILL:
An act to amend the executive law, in relation to establishing a duty to
report an unauthorized use of force by a police officer
 
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of the bill is to require police officers to intervene and
report incidents of police misconduct.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 amends the executive law to require police officers to inter-
vene on and report instances of unauthorized use of force. Failure to
intervene and report is classified as a class B misdemeanor.
Section 2 sets forth the effective date.
 
JUSTIFICATION:
Police intervention is an important tool in handling and preventing
police misconduct. Officers who see fellow officers engaging in unlawful
or unauthorized use of force will be in the best position to prevent any
death or injury at the hands of such law enforcement officers. Addi-
tionally, the requirement to report is an additional prophylactic that
will ensure accountability.

EFFECTIVE DATE:
