TITLE OF BILL:
An act to amend the public health law, in relation to hospital-sponsored
off campus emergency departments
 
PURPOSE:
To require a full certificate of need review for the downgrading of a
full-time emergency department to part-time status.
 
SUMMARY OF PROVISIONS:
Section 1: Amends section 2801 of the public health law by including
"hospital-sponsored off campus emergency department" under the defi-
nition of hospital.
Section 2: Amends section 2801 of the public health law by defining
"hospital-sponsored off campus emergency department".
Section 3: Adds a new section 2802-C to the Public Health Law by estab-
lishing the hours of operation guidelines for emergency departments and
hospital-sponsored off campus emergency departments.
Section 4: Sets effective date.
 
JUSTIFICATION:
There have been several applications to downgrade the full-time emergen-
cy department to part-time status. Given these requests' unique and
unprecedented nature, a full certificate of need review is appropriate.
This bill ensures that any application to reduce services at a full-time
emergency department to part-time status requires a full certificate of
need review and approval by the Public Health and Health Planning Coun-
cil. Such approval shall only be made upon finding that local special
circumstances necessitate part-time operation and with consideration for
the quality and accessibility of emergency care and the public interest.
