TITLE OF BILL:
An act to amend the social services law, in relation to requiring local
child protective services to notify appropriate military personnel when
a member of the armed forces is the subject of a report of child abuse
or maltreatment
 
PURPOSE:
To ensure that case file information shared with the United States
Department of Defense is consistent and establishes guidelines that
would increase this collaboration.
 
SUMMARY OF PROVISIONS:
Section 1: Section 424 of the social services law is amended by adding a
new subdivision 3-a
Section 2: Amends subdivision 5-a of section 424 of the social services
law as added by chapter 494 of the laws of 2006
Section 3: Amends subdivision 5-b of section 424 of the social services
law as added by chapter 494 of the laws of 2006
Section 4: Amends subdivision 1 of section 424-a of the social services
law
 
JUSTIFICATION:
State statute directing the collection of military affiliation as part
of the child abuse and neglect response process and sharing pertinent
case file information with the appropriate military authorities can
provide consistency and complement the statutory responsibility of the
United States Department of Defense.
New York State can adopt this legislation to increase collaboration
between the United States Department of Defense and state/local govern-
ments to fulfill the DoD's statutory obligation to address child abuse
and neglect.
This type of approach to collaborative oversight is crucial for a better
coordination of local child welfare and military.
