TITLE OF BILL:
An act to amend the real property actions and proceedings law and the
New York city charter, in relation to enforcement of housing code
violations
PURPOSE OR GENERAL IDEA OF BILL::
To enforce the penalties for violations of the housing maintenance code
in New York City.
SUMMARY OF PROVISIONS::
Section 1. Section 770 of the Real property actions and proceedings law
is amended tc read that if the owner or owner's agent fails to correct
or cure twenty or more violations of the housing maintenance code that
exist for more than 12 consecutive months, the commissioner shall
commence a proceeding under this Article to be appointed as Administra-
tor of such property. Section 2. Section 778 of the real property
actions and proceedings law is amended to authorize the court to imple-
ment a judgment to appoint a person other than the owner, mortgage or
lienor to receive and administer the rent money or security deposited
with the owner, mortgage or lienor. And the court can appoint the
Commission of the department of the City of New York charged with the
enforcement of the housing maintenance code. Section 3. The New York
City charter is amended by adding Section 1802-a, whereby the department
will establish a list of owners and managers of multifamily residential
buildings that commit violations, further lists the violations and
penalties for same. Section 4. Sets forth the effective date
JUSTIFICATION::
An act to increase the penalties for the landlords and/or property
owners who regularly appear on the "Worst Landlord List" for violations
issued by the Department of Housing Preservation and Development (HPD)
related to the average number of open housing code violations issued

EFFECTIVE DATE::
This act shall take effect on the ninetieth day after it shall have
become a law.
