TITLE OF BILL:
An act to amend the education law and the public health law, in relation
to providing public access to epinephrine auto-injector devices at
schools
PURPOSE:
This legislation will require an epinephrine auto-injector device to be
maintained and tested along with a notice of the location in schools.
SUMMARY OF PROVISIONS:
Section 1: "Public access epinephrine auto-injector device provider" is
any school district, boards of cooperate educational services, county
vocational education, and extension boards, charter schools, and non-
public elementary and secondary schools.
Section 2: Amends the public health law to add "public access epineph-
rine auto-injector device provider" to be a person, firm, organization,
or other entity possessing or operating an epinephrine auto-injector
device.
Section 3: Requires the provider of an epinephrine auto-injector device
to ensure the device is maintained and tested appropriately; notify the
regional council of the existence, location, and type of the device;
post a sign or notice at the main entrance of the building in which the
device is located.
Section 4: is the effective date.
JUSTIFICATION:
Epinephrine injectors in schools need to be treated the same way as an
automated external defibrillator, or AED. Both devices are lifesaving,
and it is crucial we have immediate access to them in case of an unfor-
tunate emergency. According to a report from Blue Cross Blue Shield,
nearly eighteen percent of children suffer from one or more allergy.
Equipping our schools and related facilities with the necessary
resources will save the lives of many children.

This act shall take effect on the ninetieth day after it shall become a
law.
