TITLE OF BILL:
An act to amend the retirement and social security law, in relation to
military service credit
 
SUMMARY OF PROVISIONS:
Section 1. Amends Subdivision 1 of section 1000 of the retirement and
social security law to clarify the definition of a qualifying condition
and a discharged LGBTQ+ veteran. It also includes active military duty
to include services performed under the authority of the Governor of New
York.
Section 2. This act shall take effect immediately.
 
JUSTIFICATION:
With respect to retirement and social security, some service members who
have served our state and nation have been left out of benefits general-
ly made available for those served in active-duty roles. The purpose of
this legislation will also include the New York State active-duty
service performed under the authority of the Governor of New York State.
This legislation would ensure that those who serve our country in thea-
tres outside of armed conflict still gain the benefits they would other-
wise be entitled to. It also ensures that those who may not have been
covered under the definitions provided under the Executive law, not have
coverage under the definitions of the Veterans' Service law.
