TITLE OF BILL:
An act to amend the public service law, in relation to enacting the
"state and local clean energy partnership"
 
PURPOSE:
To establish the State and Local Clean Energy Partnership.
 
SUMMARY OF PROVISIONS:
Section 1 establishes the act as the "State and Local Clean Energy Part-
nership."
Section 2 outlines legislative findings and purpose, recognizing Commu-
nity Choice Aggregation (CCA) as a tool for local governments to procure
clean energy, facilitate community engagement in renewable energy
programs, and advance the state's climate goals. It affirms the state's
support for CCA, highlights its benefits in securing competitive energy
contracts, and promotes the inclusion of Community Distributed Gener-
ation (CDG) to expand access to renewable energy, particularly for
disadvantaged communities.
Section 3 amends the public service law by adding a new section 74-c,
which:
*Defines CCA and its role in municipal energy procurement.
*Establishes guidelines for municipalities to create CCA programs
through local law.
*Provides for CCA administrators to manage these programs.
*Incorporates CDG as part of CCA programs, enabling shared renewable
energy generation and utility bill credits for participants.
Section 4 includes a severability clause ensuring that if any part of
the act is deemed invalid, the remaining provisions remain in effect.
Section 5 sets the effective date.
 
JUSTIFICATION:
This bill helps strengthen New York State's commitment to clean energy
by codifying Community Choice Aggregation (CCA) programs into law,
ensuring broader access to affordable renewable energy. By empowering
municipalities to procure clean energy on behalf of residents and inte-
grating Community Distributed Generation (CDG), the bill also expands
opportunities for low- and moderate-income households to benefit from
cost savings and sustainability efforts.It aligns with the state's CLCPA
goals by promoting local renewable energy adoption, reducing greenhouse
gas emissions, and supporting disadvantaged communities. Additionally,
it provides clarity and regulatory consistency to encourage widespread
participation in CCA programs, which helps foster community-driven ener-
gy choices that contribute to a cleaner, more equitable energy future
for New York.
