TITLE OF BILL:
An act to amend the public service law, in relation to limits on
surcharge increases; directing a study of the costs associated with
recent environmental and energy related laws and the value of stranded
utility assets resulting in discontinuance and/or abandonment of utility
gas infrastructure; and imposing a moratorium on new energy taxes, fees
and regulations
PURPOSE:
To limit surcharge increases and study the impact of state policies and
regulations on ratepayers.
SUMMARY OF PROVISIONS:
Section 1. Titles the bill the "Energy Assessment Cap and Consumer Cost
Relief Act."
Section 2. Amends the public service law by adding a new section 18
which limits the surcharge increases the commission may issue.
Section 3. Directs the Department of Public Service to issue requests
for proposals for an independent vendor to conduct a cost study of state
policies and regulations associated with environmental and energy
related laws issued since 2019.
Section 4. Directs the Department of Public Service to issue requests
for proposals for an independent vendor to conduct a study on the value
of stranded assets.
Section 5. Issues a moratorium on new energy taxes, fees, and regu-
lations for a five year period.
Section 6. Sets the effective date.
JUSTIFICATION:
New Yorkers have seen utility bills skyrocket since the implementation
of the CLCPA. It is important that we give ratepayers some relief while
we figure out exactly what the fiscal ramifications of implementing the
CLCPA will be. Moving forward with the provisions of the CLCPA must come
with transparency for ratepayers and getting an unbiased third party
opinion is the best way to bring that to fruition.
