TITLE OF BILL:
An act to authorize the town of Union Vale, county of Dutchess, to
alienate and discontinue the use of certain parklands
 
PURPOSE OR GENERAL IDEA OF BILL:
To authorize the Town of Union Vale to alienate a parcel of parkland in
Tymor Park for the purpose of leasing the parkland for a cell phone
tower to improve service and connectivity for residents and emergency
response services.
 
SUMMARY OF PROVISIONS:
Section 1: Authorizes the Town of Union Vale to discontinue the use of
specific parklands and lease the property to Homeland Towers at fair
market value for an initial term of ten years, with an option to extend
up to six five-year renewals.
Section 2: Conditions the authorization on the town dedicating funds
equal to or greater than the fair market value of the parklands being
discontinued towards acquiring new parklands and/or capital improvements
to existing recreational facilities.
Section 3: Describes the land to be discontinued and leased, including
Lease Area A ( approximately 5,250 square feet, or 0.120 acres) and
associated easement areas for vehicular and pedestrian access.
Section 4: Specifies that if the land ceases to be used for the purpose
authorized in the bill, the lease shall terminate and the land shall
revert to the town of Union Vale for public park and recreational
purposes. Requires the removal of the wireless communication tower in
such an event. Section 5: Addresses the event that the town has received
funding from the federal government for park purposes on the designated
land. Section 6: Provides the effective date.
 
JUSTIFICATION:
The Town of Union Vale has identified a need to enhance wireless commu-
nication infrastructure to improve service and connectivity for resi-
dents and emergency response services. The placement of a wireless
communication tower in this location will help meet these needs while
ensuring that the town invests in maintaining and enhancing public park-
lands. By requiring that proceeds from the lease be used for new or
improved park facilities, this legislation ensures that the community
will not lose recreational opportunities and will continue to benefit
from parkland investments.
