TITLE OF BILL:
An act to amend the public health law, in relation to residential health
care facility rates
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 amends paragraphs a, b, c, and d of subdivision 2-c of section
2808 of the Public Health Law, as it relates to residential healthcare
facilities in regard to rates of payment, to establish a schedule, upon
which the Department of Health (DOH) would rebase expenses and update
Medicaid rates accordingly. It also adds a new paragraph b1 to establish
a technical assistance work group with which the DOH would consult.
Section 2 provides an effective date.
JUSTIFICATION:
The current rate methodology for nursing homes has not been updated in
15 years. As a result, their rate hasn't changed in 15 years. To set
Medicaid rates, DOH does a look-back of expenses in the categories of
facilities. Other states that surround New York rebase expense calcu-
lations as the basis for Medicaid rates regularly. This bill would
ensure that rates keep pace with rising expenses and establish a sched-
ule upon which the DOH would be required to rebase expenses and update
Medicaid rates accordingly.
