TITLE OF BILL:
An act to amend the military law, in relation to providing for
reimbursement for certain insurance premiums for certain members of the
naval militia, New York air, army national guard, and New York guard

SUMMARY OF PROVISIONS:
Section 1: Section 210 of the military law is amended by adding a new
subdivision 10. Any New York resident member of the Naval Militia, New
York Air, Army National Guard and New York Guard who, when activated
pursuant to a call of the governor of this state or any other state as
provided for by law, shall be reimbursed by the state for premiums asso-
ciated with any individual or group health insurance policy, including
benefits pursuant to TRICAE, or which the naval militia, New York Air,
army national guard and New York guard member is a policy owner or bene-
ficiary.
Such reimbursement shall equal one-thirtieth the amount of naval mili-
tia, New York air, army national guard and New York guard member's
monthly premium for each day of service.
The state shall not be responsible for the procurement of health insur-
ance policies on behalf of members of the militia.
Premiums reimbursed for the provision of service members' health insur-
ance shall be paid only to provide coverage that is not paid for or
reimbursed by any other governmental entity. In no event shall a service
member who declines health insurance be entitled to any direct payment
pursuant to the terms of this section.
The adjutant general shall, in consultation with the state comptroller,
promulgate rules and regulations necessary to implement the provisions
of this subdivision.
Section 2: This act shall take effect immediately.

JUSTIFICATION:
The New York Naval Militia, New York Air, Army National guard, and New
York Guard are components of the New York State defense forces. As part
of the New York State defense forces, these entities complement the Army
and Air National Guard programs, as well as the New York State Guard.
When the Governor of New York State activates this component of the New
York State defense forces they should be fairly compensated for their
service on all fronts, especially when it comes to insurance premiums.
