TITLE OF BILL:
An act to amend the general city law, the town law, and the village law,
in relation to requiring each town, village, and city to develop a hous-
ing action plan for everyone
PURPOSE OR GENERAL IDEA OF BILL:
This bill would require each city, town and village to develop a Housing
Action Plan for Everyone to identify a locality's housing needs.
SUMMARY OF PROVISIONS:
Section 1. Amends the General City Law by adding a new section 28,
titled, "Housing Action Plan for Everyone" (HAP-E). Each city shall
adopt a HAP-E to increase the amount of available housing. 2. Lists, in
part, some factors that may be considerations in drafting their HAP-E.
3. Lists concepts that may be considered such as legalizing accessory
dwelling units, changing parking requirements, authorizing transit-or-
iented development zones, streamlining permit processes and authorizing
as-of-right and mixed-use zones. 4. The amount of new housing contem-
plated in the HAP-E for each city may consider the Area Median Income
(AMI) calculations set forth by the US Department of Housing and Urban
Development, which consists of five levels. 5. Each city's Planning
Board or appointed group, shall submit the HAP-E to the mayor and legis-
lative body for review or further recommendations. These Planning
Boards or appointed groups may coordinate with local planning associ-
ations, non-profits, builders, realtors, housing councils, the
construction industry, and community stakeholders in the development of
such a plan. 6. The finalized plan must be posted on the city's website
and the original must be received by the New York State Division of
Housing and Community Renewal. Each plan shall hold one public hearing
within 30 days of completion of the HAP-E. 7. Regional Economic Develop-
ment offices shall assist municipalities in notifying them of grants and
funding options that may be available to the city to help implement the
HAP-E. The HAP-E must be completed within twelve months of the effective
date of this section, and if not completed a one-time, three-month
extension may be granted if the Division of Housing and Community
Renewal confirms the plan has been substantially completed.
Section 2. Amends the Town Law by adding a new section 272, titled,
"Housing Action Plan for Everyone". This is to read like Section 1,
found above, except it has been slightly altered to pertain to towns.
Section 3. Amends the Village Law by adding a new section 7-720, titled,
"Housing Action Plan for Everyone". This is to read like
Section 1, found above, except it has been slightly altered to pertain
to villages.
Section 4. Establishes the effective date.
JUSTIFICATION:
This bill would require all communities to develop a Housing Action Plan
for Everyone (HAP-E) to determine what needs to be accomplished to meet
their identified housing needs. Localities including villages, towns,
and cities would benefit from knowing their housing needs and planning
for the construction and preservation of the housing types that must be
created to meet those needs. In developing this plan, localities can
also look to an array of individuals for input like Assemblymembers
Levenberg and Burdick did for their symposium.
While the legislation does not mandate a HAP-E be enacted, it does
mandate it be completed in good faith.
