TITLE OF BILL:
An act to amend the public authorities law, in relation to the process
for filling vacancies on the Long Island rail road commuter's council
PURPOSE:
To reduce the number of names a county executive is required to submit
to fill a vacancy on the Long Island Rail Road Commuter Council from
three to one.
SUMMARY OF PROVISIONS:
Section 1 amends section 1266-D of the public authorities law to reduce
the number of names required to be submitted in order to fill a vacancy
on the Long Island Rail Road Commuter Council.
Section two is the effective date.
JUSTIFICATION:
Unlike the New York City Transit Authority Advisory Council and Metro-
North Railroad Commuter Council (S 1204-e and § 1266-e respectively)
vacancies on the Long Island Rail Road Commuter Council (LIRRCC) are
required to be filled from a list of three names. This unique, onerous
requirement has made filling vacancies unnecessarily cumbersome for
recommending elected officials.
As more and more vacancies have accumulated, it has become progressively
more difficult for the council to achieve a quorum, represent the needs
of commuters, and conduct business. Bringing this aspect of the LIRRCC's
authorizing legislation into agreement with that of the New York City
Transit Authority Advisory Council and Metro-North Railroad Commuter
Council will resolve these issues, ensuring representatives from all
areas of the Long Island Rail Road's service territory are present when
the committee conducts official business, including but not limited to
electing a chair and MTA board member.
