TITLE OF BILL:
An act to amend the abandoned property law, in relation to requiring
abandoned property escheat to the Indian nation or tribe that histor-
ically occupied the land or to nearest nation or tribe; and to repeal
certain provisions of such law relating thereto
PURPOSE:
This bill will return escheated property to the Indian tribe or nation
that historically occupied such land.
SUMMARY OF PROVISIONS:
Sections 1-4 amend sections 200 to 203 of the abandoned property law.
Section 5 repeals section 204 of the abandoned property law.
Sections 6 - 9 amend sections 205 to 208 of the abandoned property law.
Section 10 - 14 amends section 210 to 214 of the abandoned property law.
Section 15 repeals section 215 of the abandoned property law.
Section 16 provides an effective date.
JUSTIFICATION:
This country was founded on the principle that European settlers could
take land by force, by unequal negotiation or by decree from the
original inhabitants. This bill recognizes the injustice done to the
First Nations on this continent and in this state and makes a tiny
gesture towards reparation and reconciliation. Land that has no owner
should be given back. It is the least we can do.
