TITLE OF BILL:
An act to amend the executive law and the energy law, in relation to
requiring the updating of the state uniform fire prevention and building
code and the state energy conservation construction code on the basis of
update of certain international codes
 
PURPOSE:
Direct the state Fire Prevention and Building Code Council to update the
state fire prevention and building code and the state energy conserva-
tion construction code.
 
SUMMARY OF PROVISIONS:
Section 1: Renumbers subdivision 2 of section 377 of the executive law
to subdivision 3 and adds a new subdivision 2. A new subdivision 2 is
added to require that the state uniform fire prevention and building
code and the state energy conservation code be updated in accordance
with changes in international fire codes. These codes include the Inter-
national Building Code, the International Fire Code, the International
Residential Code, the International Plumbing Code, the International
Mechanical Code, the International Property Maintenance Code, and the
National Electrical Code. New subdivision 2 states that each time a
revised edition of a code is updated, the council shall update the
uniform within twelve months of such publication. The fire prevention
and building code will be updated to reflect such changes.
Section 2: Amends section 11-101 of the energy law to update the purpose
of a state energy construction code. Section 3 states that the Fire
Prevention and Building Code Council may decide to update a code if it
is cost-effective. In determining if it is cost-effective, the council
shall consider the cost of their installation to meet its standards to
be equal to or less than the present value of energy savings that could
be expected over 10 years from when the materials are installed. For
residential buildings, the code shall meet or exceed the then most
recently published International Energy Conservation Code or achieve
equivalent or more significant energy savings and cause the state energy
conservation constriction code to be updated to reflect such changes.
Section 3: Amends subdivision 2 of section 11-103 of the energy law
authorizes the State Fire Prevention and Building Code Council to
review, amend, or adopt a new code, ensuring it remains cost-effective.
The council must assess cost-effectiveness based on life-cycle cost
analysis and consider secondary or societal effects, such as reductions
in greenhouse gas emissions. Public meetings must be held for input,
particularly from disadvantaged communities. The code must meet or
exceed the most recent International Energy Conservation Code for resi-
dential buildings or achieve equivalent energy savings. Commercial
buildings must meet or exceed ANSI/ASHRAE/IESNA Standard 90.1 or achieve
equivalent savings. The council must adopt energy-saving provisions
recommended by the New York State Energy Research and Development
Authority (NYSERDA) within 18 months of each revised edition of these
standards, ensuring advanced energy savings while maintaining cost-ef-
fectiveness. Additionally, the council must update the State Energy
Conservation Construction Code within 18 months of any revisions to
these standards.
Section 4: Sets Effective Date.
 
JUSTIFICATION:
This changes the amount of time after the publication the council has to
update the uniform fire prevention and building code from 12 months to
18 months.
