TITLE OF BILL:
An act to amend the village law, in relation to filling vacancies in
elective offices in villages with November elections
PURPOSE:
To ensure that vacancies in elected village offices are filled in
accordance with the political calendar prescribed by the election law.
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 of the bill amends § 3-312 of the village law to specify how
vacancies in elected village offices are filled when a village election
is conducted in November.
Section 2 provides the effective date.
JUSTIFICATION:
Pursuant to election law § 15-104, villages may authorize county boards
of election to conduct village elections on the same day as the general
election in November. However, the timing to fill vacancies provided in
the village law is inconsistent with the political calendar for
elections conducted on general election day. Consequently, many
villages with November elections are unable to designate or nominate
candidates for vacated village offices and need to have such candidates'
names printed on the ballot and candidates may only be elected by write-
in vote.
This bill would correct the conflict between the village law and the
election law and require vacancies to be filled in accordance with the
political calendar set forth in the election law.

EFFECTIVE DATE:
