TITLE OF BILL:
An act authorizing the town of Brookhaven to alienate certain parklands
for use as a recharge basin and to dedicate other lands as replacement
parklands
SUMMARY OF PROVISIONS:
Section One authorizes the Town of Brookhaven to discontinue the use of
certain parklands for the purposes of constructing a stormwater runoff
and recharge basin
Section 2 provides that this authorization shall be done upon the condi-
tion that the town dedicate an amount equal to or greater than fair
market value of the parklands being alienated in this act, towards the
acquisition of new parklands and/or capital improvements to existing
park and recreational facilities.
Section three provides a description of the two parcels to be alienated.
Section four provides additional provisions and stipulations for the
alienation.
Section five provides the effective date.
JUSTIFICATION:
This land alienation authorization bill has been requested by the Town
of Brookhaven. The Town is working with Suffolk County and the LI Hous-
ing Partnership to build a 32-lot single family affordable housing
development. This development and associated roadway and related
improvements requires a recharge basin to handle stormwater. The only
appropriate location for the recharge basin, based on site proximity and
topography, are two parcels of Town parkland that are undeveloped vacant
woodland. The total amount of land the Town is seeking to alienate is
1.02 acres.
