TITLE OF BILL:
An act to amend the penal law and the criminal procedure law, in
relation to creating the crime of stalking a police officer or peace
officer
PURPOSE:
To provide additional protections to police officers and peace officers
by creating the crime of stalking.
SUMMARY OF PROVISIONS:
Section 1: Amends Section 120.40 of the Penal Law to provide various
definitions.
Section 2: Adds a new Section 120.80 of the Penal Law to create the
crime of stalking a police officer or peace officer.
Sections 3 through 5 amend various sections of the Criminal Procedure
Law to provide that bail may be considered for this crime.
Section 6: Provides an effective date of 30 days after the bill has
become law.
JUSTIFICATION:
Our police officers go above and beyond every single day, putting their
lives on the line for our safety. They should not have to bring their
work home in the form of being stalked. This bill would provide addi-
tional protections to police and peace officers who find themselves
being stalked or harassed by someone. Attacks on police officers in any
form are not acceptable.
