TITLE OF BILL:
An act to amend the insurance law and the vehicle and traffic law, in
relation to electronic delivery of notices
PURPOSE:
To permit policyholders to receive electronic notices under the Vehicle
and Traffic Law.
SUMMARY OF PROVISIONS:
Amends subsection (b) of Section 3458 of the Insurance Law, as amended
by a chapter amendment, to reference Vehicle and Traffic Law to allow
for electronic delivery in relation to requirements to provide a notice
or document. Adds a new paragraph (c) to subsection 313(1) of the Vehi-
cle and Traffic Law to permit notices of cancellation to be delivered
electronically by insurers if the provisions of section 3458 of the
Insurance Law are followed.
JUSTIFICATION:
Section 3458 of the Insurance Law was enacted to permit those policy-
holders who have consented to receive notices electronically to allow
insurance companies to provide those notices electronically. Unfortu-
nately, this same consent does not apply to the provisions of the Vehi-
cle, so policyholders do not have the ability to receive all information
electronically if that is their preference. This legislation seeks to
remedy that by allowing notices required under the Vehicle and Traffic
Law to be provided electronically as long as the provisions of Insurance
Law 3458 have been followed.
