TITLE OF BILL:
An act in relation to authorizing Alexander D. Rusin to receive retroac-
tive membership in the New York state and local employees' retirement
system
 
PURPOSE:
Authorizes Alexander D. Rusin to restore his membership date in the New
York State and local employees' retirement system.
 
SUMMARY OF PROVISIONS:
Section one authorizes Alexander D. Rusin to be reinstated in Tier IV of
the NYS retirement system due to reasons not ascribable to his own
negligence, failed to become a member of such system during his employ-
ment by the Erie County Water Authority in 2008.
Section 2. States no contributions made by Alexander D. Rusin to the New
York state and local employees' retirement system be returned or
refunded to him pursuant to this act.
Section 3. Requires all past service costs be borne by the Erie County
Water Authority.
Section 4. Establishes the effective date.
 
JUSTIFICATION:
Alexander D. Rusin was employed by the Erie County Water Authority as a
Meter Service Worker during the summer of 2008 and again in 2009. Due
to no fault of his own, Mr. Rusin did not become a member of the New
York State and local employees' retirement system at that time. This
legislation aims to correct the oversight, by authorizing Mr. Rusin to
join the retirement system as of June 2, 2008.
