TITLE OF BILL:
An act to amend the alcoholic beverage control law, in relation to the
sale of private-label liquor at retail for consumption off the premises
PURPOSE OR GENERAL IDEA OF BILL:
To amend the alcoholic beverage control law, SUMMARY OF PROVISIONS:
Section 1: Amends the alcoholic beverage control law by adding a new
section, 106-c, and provides definitions for "private-label liquor",
"holder of a license to sell liquor at retail for consumption on the
premises", and "licensed distiller." A holder of a license to sell
liquor at retail for consumption on the premises may sell bottles of
private-label liquor at retail for off-premises consumption provided
that such private-label liquor is: distilled within the borders of the
state of New York by a licensed distiller; and not sold in excess of a
volume of seventy-five thousand gallons per year. The label of the
private-label liquor shall clearly indicate that the product is produced
by a licensed distiller. The total annual sales volume of private-label
liquors as allowed under this section by a holder of a license to sell
liquor at retail for consumption on the premises shall be reported to
the liquor authority annually by such holder of a license to sell liquor
at retail for consumption on the premises.
Section 2: This act shall take effect on the one hundred-eightieth day
after it shall have become a law.
JUSTIFICATION:
The craft beverage industry is a cornerstone of New York's economy and
will continue to be relied upon for increases in jobs and tax revenues.
This bill will continue to help that industry grow and encourage New
Yorkers to support local sellers and restaurants.
Craft alcohol is a unique industry in that it is solely comprised of
mom-and-pop companies. Considering increasing barriers to running small
businesses, including inflation, providing another pathway for the craft
beverage industry to distribute its product is critical.
