TITLE OF BILL:
CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing an amendment
to article 7 of the constitution, relating to revenues of the power
authority of the state of New York
 
PURPOSE:
To keep NYPA revenues in the host communities of revenue generators
 
SUMMARY OF PROVISIONS:
Section 1 amends Article 7 of the State Constitution to ban the sweep of
NYPA funds into the NYS general fund.
 
JUSTIFICATION:
The Niagara Power Plant is responsible for generating an overwhelming
majority of the New York State Power Authority's (NYPA) revenue; howev-
er, NYPA routinely diverts these profits from western New York into the
NYS general fund to cover state's spending. The money that was taken
from NYPA should not go toward footing the bill for New York State's
spending. Instead, it should be reinvested into NYPA host communities
and help fund rate relief and economic development projects.

FISCAL IMPLICATIONS ON THE STATE:
NYPA's revenue would not be moved into the general fund.
 
EFFECTIVE DATE:
Resolved (if the concur), That the foregoing amendment be referred to
the first regular legislative session convening after the next succeed-
ing general election of members of the assembly, and, in conformity with
section 1 of article 19 of the constitution, be published for 3 months
previous to the time of such election.
