TITLE OF BILL:
An act amend the social services law, in relation to making technical
changes to certain provisions of such law; to repeal sections 2, 3, 4
and 5 of a chapter of the laws of 2024 amending the social services law
relating to requiring maintained records for certain children to include
whether they have a developmental disability; and conducting a study on
the number of children in foster care who have a developmental disabili-
ty; as proposed in legislative bills numbers S. 8679-A and A. 8846-A, in
relation to conducting a study to determine the number of children in
foster care and who have been diagnosed with a developmental disability;
and to amend a chapter of the laws of 2024 amending the social services
law relating to requiring maintained records for certain children to
include whether they have a developmental disability; and conducting a
study on the number of children in foster care who have a developmental
disability, as proposed in legislative bills numbers S. 8679-A and A.
8846-A, in relation to the effectiveness thereof
PURPOSE:
This is a chapter amendment that makes changes to provisions of L.2024,
c.663, to clarify provisions relating to a study of the number of chil-
dren in foster care who have a developmental disability and inclusion of
information regarding a child's developmental disability in required
record keeping.
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by repealing the
provisions related to and requiring a study of the number of children in
foster care who have a developmental disability. The effective date is
also amended from being immediate to an effective date of one year
following the bill becoming law.
EXISTING LAW:
None.
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 663 of the Laws of 2024. S.8679-A and
A.8846-A both passed the Senate and Assembly, respectfully, in June
2024.
FISCAL IMPLICATIONS:
Minimal fiscal implications to the State and no fiscal impact on local
governments.
EFFECTIVE DATE:
This act shall take effect immediately; provided, however, that sections
one and two of this act shall take effect on the same date and in the
same manner as a chapter of the laws of 2024 relating to requiring main-
tained records for certain children to include whether they have a
developmental disability; and conducting a study on the number of chil-
dren in foster care who have a developmental disability, as proposed in
legislative bills numbers S. 8679-A and A. 8846-A, takes effect.
