TITLE OF BILL:
An act to amend the public authorities law, in relation to requiring the
metropolitan commuter transportation authority to obtain approval from
the state comptroller to increase fares
PURPOSE:
Requires any proposed increase in fares by the Metropolitan Commuter
Transportation Authority to be submitted to the comptroller for
approval.
SUMMARY OF PROVISIONS:
Section 1. Amends subdivision 1 of section 1205 of the public authori-
ties law to require the approval of the state comptroller to increase
rates or fares.
Section 2. Amends § 1207-i of the public authorities law to make
conforming changes.
Section 3. Amends subdivision 3 of section 1266 of the public authori-
ties law to make conforming changes.
Section 4. Adds a new section 1265-c to the public authorities law to
outline the procedure for the comptroller to review and approve or deny
any rate or fare increase.
Section 5. Effective date.
JUSTIFICATION:
Increased commuter fares affect thousands of citizens who commute in and
throughout New York City. In 2004, the MTA recently approved a 25% fare
increase without disclosing the fact that a second set of books main-
tained by the authority, and disclosed to the public, indicate that the
fiscal condition of the MTA was not as dire as presented to justify the
increase. To avoid similar misrepresentations in the future, the comp-
troller should review proposed fare increase for the best view on its
impact to the entire State.

FISCAL IMPLICATIONS:
None.
EFFECTIVE DATE:
This act shall take effect on the ninetieth day after it shall have
become a law and shall apply to any fares increased on or after such
effective date.
