TITLE OF BILL:
An act to amend the public authorities law, in relation to the New York
power authority's conferral process
PURPOSE:
This bill requires regular updates on the New York Power Authority's
work to build public renewables and added transparency requirements
around their annual conferral process.
SUMMARY OF PROVISIONS:
Section one of the bill sets the short title as the "Public Renewables
Transparency Act."
Section two of the bill amends subdivision 27-a of § 1005 of the public
authorities law, as amended by § 28 of part 0 of chapter 58 of the laws
of 2024, to require reports on public renewable development at each
board of trustees' meeting.
Section three of the bill amends subdivision 27-a of § 1005 of the
public authorities law, as amended by § 1 of part QQ of chapter 56 of
the laws of 2023, to require reports on public renewable development at
each board of trustees' meeting.
Section four of the bill amends subparagraph (vii) of paragraph (e) of
subdivision 27-a of § 1005 of the public authorities law to specify
October eleventh as the date for the authority to publish a draft of the
strategic plan for at least sixty days to receive public comments,
increasing the number of public hearings from at least three to at least
six, providing an option for stakeholders to submit feedback remotely,
and requiring the authority to incorporate feedback from the public
hearings and feed back into the final draft of the strategic plan.
Section five of the bill sets the effective date.
JUSTIFICATION:
As the New York Power Authority begins to implement the Build Public
Renewables provisions from the FY2024 budget, various stakeholders
inside and outside of government are interested in seeing additional
transparency in the conferral process and the implementation of the
resulting strategic plan.

EFFECTIVE DATE:
This act shall take effect immediately, provided that the amendments to
paragraph (d) of subdivision 27-a of section 1005 of the public authori-
ties law made by section two of this act shall be subject to the expira-
tion and reversion of such paragraph pursuant to section 34 of part 0 of
chapter 58 of the laws of 2024, as amended, when upon such date the
provisions of section three of this act shall take effect.
