BILL NUMBER: S2307
SPONSOR: COMRIE
TITLE OF BILL:
CONCURRENT RESOLUTION OF THE SENATE AND ASSEMBLY proposing amendments to
article 6 of the constitution, in relation to the number of supreme
court justices in any judicial district
PURPOSE:
To increase the number of supreme court justices in districts where the
maximum has been reached.
SUMMARY OF PROVISIONS:
Section one of the bill amends subdivision d of section 6 of article 6
of the constitution to adjust the limitation of one supreme court
justice for every fifty thousand people to one for every thirty thousand
people.
Section two of the bill provides the effective date.
JUSTIFICATION:
The New York Constitution caps the number of justices in each judicial
district at one for every fifty thousand people; Certain judicial
districts of the state have already reached this limit. Allowing one
Supreme Court justices for every thirty thousand people rather than
fifty thousand people will reduce the backlog of cases which currently
exists and help alleviate the burden on the judicial branch.
