TITLE OF BILL:
An act to amend the administrative code of the city of New York and the
emergency tenant protection act of nineteen seventy-four, in relation to
surcharges assessed for the late filing of rent registration statements
PURPOSE OR GENERAL IDEA OF BILL::
This bill would disincentivize owners from the late registration of rent
regulated units with the Division of Homes and Community Renewal.
SUMMARY OF PROVISIONS::,;..
Section 2 amends the emergency tenant protection act of 1974 to increase
the late registration surcharge from $500 to $1000 if the late registra-
tion is determined to be willful.
Section 1 amends the administrative code of the City of New York to
increase the late registration surcharge from $500 to $1000 if the late
registration is determined to be willful.
Section 3 provides the effective date.
JUSTIFICATION:
New York's rent regulated housing stock provides neighborhood stability
and affordability for close to 2 million New Yorkers in an increasingly
unaffordable and capricious housing market.
Owners have a duty to register their regulated units with DHCR but the
existing penalty for a failure to do so is not high enough to discourage
delaying registration, which unscrupulous owners can do in an attempt to
deregulate their unit. This bill distinguishes between willful and unin-
tentional failure to register a unit and imposes appropriate penalties
to ensure owners comply with the law by registering their regulated
units in a timely fashion.
