TITLE OF BILL:
An act to amend the public service law and the environmental conserva-
tion law, in relation to increasing the statewide energy storage capaci-
ty
 
PURPOSE OR GENERAL IDEA OF BILL:
This bill increases the State's energy storage target for 2030 estab-
lished by the Climate Leadership and Community Protection Act (CLCPA)
from 3 GW to 6 GW.
 
SUMMARY OF PROVISIONS:
Section one amends subdivision 1 of section 137 of the public service
law to increase the statewide energy storage capacity target for 2030
from 3 GW to 6 GW.
Section two amends paragraph e of subdivision 13 of section 75-0103 of
the environmental conservation law to increase the statewide energy
storage capacity target for 2030 from 3 GW to 6 GW.
Section three amends subdivision 5 of section 66-p of the public service
law to increase the statewide energy storage capacity target for 2030
from 3 GW to 6 GW.
Section four sets forth the effective date.
 
JUSTIFICATION:
In 2019, New York State enacted the Climate Leadership and Community
Protection Act (CLCPA), the nation's most comprehensive climate legis-
lation. In 202, the State enacted specific statutory CLCPA targets for
renewable energy generation, including a requirement that the State
procure a minimum of 3 gigawatts (GW) of energy storage capacity by
2030.
On January 5, 2022, New York Governor Kathy Hochul announced in her
State of the State address an intention to double the state's 2030 ener-
gy storage deployment target, from the currently legislated 3 GW of
storage to 6 GW of storage by 2030. The Department of Public Service
(DPS) and the New York State Energy Research and Development Authority
(NYSERDA) were directed to, and subsequently did, update New York
State's Energy Roadmap to achieve at least 6 GW of energy storage
deployment by 2030.
Energy storage is a key enabling technology to achieve the state's
renewable energy and climate goals, providing increased grid flexibili-
ty, enabling the wide scale deployment of renewable energy, promoting
efficient use of grid resources, and enhancing grid resiliency.
This legislation will codify the increase of energy storage capacity
from 3 GW to 6 GW by 2030, enabling us to meet our CLCPA goals while
maintaining reliability.

EFFECTIVE DATE:
This act shall take effect immediately; provided, that the amendments to
section 137 of the public service law made by section one of this act
shall not affect the repeal of such section and shall be deemed repealed
therewith.
