TITLE OF BILL:
An act to amend the education law, in relation to establishing the
"dismantling student antisemitism act"
PURPOSE:
To implement antisemitism awareness and prevention sensitivity training
at all higher education accredited institutions, and to record and
report on incidents of hate and discrimination related to antisemitism
which occur at such institutions.
SUMMARY OF PROVISIONS:
Creates a new section of the Education Law, 6436-a, to require all high-
er education accredited institutions within the State to adjust sensi-
tivity training seminars for administrators, faculty, staff, and
students to include training pertaining to antisemitism awareness and
prevention. Additionally, requires all higher education accredited
institutions to report incidents of hate and discrimination related to
antisemitism to the New York State Education Department on an annual
basis. This act also requires the New York State Education Department to
develop an aggregated report on incidents of hate and discrimination
related to antisemitism at higher education accredited institutions, and
to make such report available to the public.
As provided in Education Law Section 6430, failure to comply with the
provisions within this act such institution will not be eligible to
receive any State aid or assistance until such compliance is filed.
JUSTIFICATION:
The Anti-Defamation League reports that incidents of antisemitism in New
York State alone accounted for 15.7 percent of all documented antisemi-
tic incidents in the United States in 2022, the highest rate of reported
antisemitic incidents of any State throughout the nation. The DSA Act
requires higher education accredited institutions to implement antisemi-
tism awareness and prevention in administrative, faculty, staff, and
student sensitivity training seminars. Further, the intent of the Act is
to record and provide transparency on the frequency of these incidents
which occur on the campuses of higher education institutions, and to
actively assist individuals in recognizing and responding to hate and
discrimination related to antisemitism on college campuses.

FISCAL IMPLICATIONS:
To be determined. Potential withholding of State aid to higher education
accredited institutions that are found to be not in compliance of this
Act. Potential costs to higher education accredited institutions to
implement antisemitism awareness and prevention in administrative,
faculty, staff, and student sensitivity training seminars.
EFFECTIVE DATE:
This act shall take effect immediately.
