TITLE OF BILL:
An act to amend the penal law, in relation to categorizing the assault
of a code enforcement official or other individual responsible for
building inspection as a class D felony
 
PURPOSE:
To enhance penalties for assaults against code enforcement officials.
 
SUMMARY OF SPECIFIC PROVISIONS:
Section 1. Amends section 120.05 of the Penal Law to include assaults
against code enforcement officials as offenses of second-degree assault.
2. Establishes that these offenses constitute a class D felony.
 
JUSTIFICATION:
Code enforcement officials ensure the habitability of residential units
and enforce critical building safety standards. Reported assaults
against these officials have increased, necessitating stronger legal
protections to ensure their safety while performing lawful duties.
