TITLE OF BILL:
An act to amend the penal law, in relation to prohibiting recording of
the entrance of a school ground
PURPOSE:
To prevent recording of students, faculty, and staff within the New York
school system.
SUMMARY OF PROVISIONS:
Section 1: Amends penal law by adding a new section, 250.75. The new
section adds definitions for the words 'school ground' and 'school
administrator'.
Furthermore, Section 1 stipulates a person is guilty of unlawful
surveillance of school property if they a) broadcast or record the
entrance or exit to a school ground, or if they b) use, install, or
permit the use or installation of a mechanical, digital, or electronic
viewing device, camera, cellular phone, or any other instrument capable
of recording, storing or transmitting visual images to view, broadcast,
or record the entrance or exit to a school ground with intent to harass,
annoy, threaten or alarm another person.
Section 1 provides a punishment for unlawful surveillance of school
property where the perpetrator is fined not more than one thousand
dollars a day.
Section 2: Sets effective date.
JUSTIFICATION:
When students, faculty, and staff arrive at school, they should not be
subjected to surveillance from adjacent properties. This is a matter of
safety and a concern for the students, faculty, and staff.

EFFECTIVE DATE:
This act shall take effect on the first of November next, succeeding the
date on which itò shall have become a law.
