TITLE OF BILL:
An act to authorize the board of trustees of the village of East Syra-
cuse to permit that the office of village justice and/or associate
justice may be held by a non-resident, provided that they reside in the
town of Dewitt
PURPOSE:
Permits the office of village justice and/or associate justice may be
held by a non-resident.
SUMMARY OF PROVISIONS:
Section one permits the office of village justice and/or associate
justice to be held by m non-resident, provided that they reside in the
town of Dewitt.
JUSTIFICATION:
Under current law, a person occupying the office of village judge is
required to be a resident of the municipality in which they reside.
Though this is an important part of representative democracy, in prac-
tice this limitation can make filling this position difficult or impos-
sible for smaller communities. East Syracuse is one such community.
Allowing the municipality to permit non-village residents of the town of
Dewitt to.be eligible for the position of .village judge will greatly
expand the pool of potential candidates while ensuring that the village
judge is still a member of the community.
