TITLE OF BILL:
An act to amend the education law, in relation to the reimbursement rate
for charter school facilities expansion in a city school district in a
city having a population of one million or more inhabitants
SUMMARY OF SPECIFIC PROVISIONS:
Section 1 amends education law section 2853 to clarify that any rental
assistance for a charter school shall be reasonable, appropriate, and
comparable to similar facilities. Section 1 also further clarifies that
rental costs should not include the cost of construction, renovation, or
areas which are not in active use as a school.
JUSTIFICATION:
This bill defines permissible rental costs eligible for charter assist-
ance.
As described in NYSED decision 18,352
(https://www.counsel.nysed.gov/Decisions/volume63/d18352) the current
language allows charter schools to be compensated for their actual"
rental costs. This legislation limits compensation to "reasonable"
rental costs and sets parameters for what does not qualify as reasonable
cost.

FISCAL IMPLICATIONS:
This bill would alleviate the burden on the city and state from possible
exploitation of the charter school rental assistance.
EFFECTIVE DATE:
This act shall take effect immediately.
