TITLE OF BILL:
An act to amend the education law, in relation to clarifying what build-
ings constitute an existing public school building for purposes of the
location of charter schools
 
SUMMARY OF PROVISIONS:
Section 1 of the bill amends education law to clarify the definition of
an existing public school building.
Section 2 sets the effective date.
 
JUSTIFICATION:
When a co-location for a charter school is proposed, a public hearing is
required for community feedback. Currently, charter schools are able to
circumvent the required public hearing for co-locations by targeting
newly constructed buildings that were built for use by a public school.
This bill would require a public hearing of all co-location requests by
including newly constructed buildings designated for potential public
school use in the definition of an "existing public school building".
