TITLE OF BILL:
An act to amend the mental hygiene law, in relation to requiring the
state to reimburse municipalities for loss of real property tax revenue
resulting from establishment of community residential facilities
PURPOSE:
Requires the state to reimburse municipalities for loss of real property
tax revenue, resulting from establishment of community residential
facilities.
SUMMARY OF PROVISIONS:
Provides that upon the establishment of a community residential facility
for the disabled by a sponsoring agency, the state comptroller shall
reimburse a municipality for loss of real property tax revenue resulting
from the establishment of such facility.
JUSTIFICATION:
The loss of tax revenue resulting from the establishment of a group home
places a substantial burden onò the community. This bill provides a
mechanism for the payment of the same taxes that would be assessed had
the dwelling not been designated as a group home to the municipality in
which the home is located.
