TITLE OF BILL:
An act to amend the highway law, in relation to providing notice to
school districts and nonpublic schools located in a city with a popu-
lation of one million or more of certain construction projects
 
PURPOSE:
To require the written notification to a school district 14 days prior
to the commencement of a construction project that may disrupt the traf-
fic to and from a school.
 
SUMMARY OF PROVISIONS:
Section 1. Section 102 of the highway law is amended by adding a new
subdivision 19 to require the written notice to a school district with
regard to the construction of a building, alteration, public utility
improvement or extension of a highway, sidewalk or appurtenance.
Subsection 2 is the effective date.
 
JUSTIFICATION:
There have been complaints by school districts that roadways and side-
walks outside of school buildings have been dug to install gas lines or
piping which has caused hazardous conditions for the students, teachers
and staff who enter and exit the school buildings. In many cases, the
school superintendent or principal were never informed of the planned
construction. By requiring 14 days notice to the school district, the
principal or other school staff in charge can plan accordingly to ensure
safe access and exit from the school building. The 14 day notification
requirement would not apply in the event of emergency situations.

EFFECTIVE DATE:
This act shall take effect on the ninetieth day after it shall have
