TITLE OF BILL:
An act to amend the state technology law, in relation to establishing
the position of chief artificial intelligence officer and the functions,
powers and duties therefor
PURPOSE:
This bill would establish the position of chief artificial intelligence
officer.
SUMMARY OF PROVISIONS:
Section 1. Amends section 101 of the .state technology law by adding two
new subdivisions, 6 and 7. Subdivision 6 defines "artificial intelli-
gence," and provides limitations to that definition. Subdivision 7
defines "Automated decision-making system," and provides limitations to
that definition.
Section 2. Amends state technology law by adding a new section 102-a,
which sets forth the functions, powers and duties of the chief artifi-
cial intelligence officer. Subdivision l establishes the office of
artificial intelligence, the appointment process for such officer, the
role of such officer, and the necessary qualifications for such officer.
Subdivision 2 sets forth the functions, powers and duties of the office
of artificial intelligence.
Section 3. Amends state technology law by adding a new section 104-a,
which creates an Advisory committee for state artificial intelligence
policy, of which the chief artificial intelligence officer shall serve
as chair. Subdivision 1 sets forth the structure of the committee and
the appointment process of its members. Subdivision 2 sets forth the
responsibilities of the committee members and rules regarding compen-
sation. Subdivision 3 provides that a committee member is not disquali-
fied from holding other public office.
Subdivision 4 sets forth minimum meeting cadence requirements.
Subdivision S sets forth the advice that the committee is to provide.
Section 4. Amends subdivisions 2 and 3 of section 102 of the state tech-
nology law, to provide that the chief Al officer has authority over the
office of the chief Al officer and that the commissioner of the office
of information technology services may not modify the office of the
chief Al officer within the office of information technology services.
Section 5. This act shall take effect on the ninetieth day after it
shall have become a law.
JUSTIFICATION:
Establishing a chief artificial intelligence officer, the office of
artificial intelligence, and an advisory committee for state artificial
intelligence policy, will cement New York State's leadership in respon-
sible artificial intelligence, enabling a thorough examination of the
benefits of its uses while being proactive in mitigating its risks.
In New York State and worldwide, artificial intelligence, algorithms,
and computational modeling services have exploded onto the market and
become fully-integrated tools for individuals and companies alike, often
automating certain historically human-conducted decision-making tasks
and functions to boost productivity. However, these systems come with
significant risks to security and privacy, unknown malfunctions, and the
demonstrated potential for discrimination to occur due to biases in
their development and operation.
This bill would centralize government-wide activities related to Al in
single office, providing best practices guidance on the responsible
procurement, development, deployment, and ongoing use of Al tools. The
Chief AI Officer would also provide a critical linkage between policy
formation happening within state government and the research activities
to be conducted at the newly formed Empire Al research consortium.
