TITLE OF BILL:
An act to amend the family court act and the general business law, in
relation to surrogacy agreements; and to amend a chapter of the laws of
2024 amending the family court act, the domestic relations law and the
general business law relating to surrogacy programs and agreements, as
proposed in legislative bills numbers S. 5107-C and A. 4921-C
PURPOSE:
This is a chapter amendment that makes changes to provisions of L.2024,
c.671.
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by removing certain
insurance provisions in the underlying chapter and clarifying that the
information on the surrogate child's birth certificate must align with
the information contained in the "Judgement of Parentage". The legis-
lation also extends the effective date of certain provisions in the
underlying chapter.

JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 671 of the Laws of 2024. S. 5107-C was
substituted by A. 4921C, and A. 4921-C passed both the Assembly and
Senate in May 2024.

EFFECTIVE DATE:
This act shall take effect immediately; provided however, that the
amendments to subparagraph (i) of paragraph 4 and paragraph 5 of subdi-
vision (g) of section 581-202 of the family court act made by section
two of this act, and to subparagraph (i) of paragraph 6 and paragraph 7
of subdivision (d) of section 581-203 of the family court act made by
section three of this act shall take effect three years after it shall
have become a law.
