TITLE OF BILL:
An act to amend the family court act and the social services law, in
relation to the "safe landings for youth leaving foster care act" or
"safe landings act"; and to amend a chapter of the laws of 2024 amending
the family court act and the social services law relating to enacting
the "safe landings for youth leaving foster care act" or "safe landings
act", as proposed in legislative bills numbers S. 8724-B and A. 9321-B,
in relation to the effectiveness thereof
 
PURPOSE:
This is a chapter amendment that makes changes to provisions of L.2024,
c.664, to clarify provisions relating to youth transitioning out of
foster care.
 
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by removing authorized
agencies as entities whom the court can issue orders of enforcement
against and permits a youth to seek enforcement until age 23, as opposed
to into perpetuity with good cause shown. The legislation also allows
for a petition for enforcement to be converted to a motion for reentry
into foster care upon consent of the youth. The effective date is
extended to 180 days and is applicable to orders issued on or after the
effective date.

None.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
 
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 664 of the Laws of 2024. S.8724-B and
A.9321-B both passed the Senate and Assembly, respectfully, in June
2024.
 
FISCAL IMPLICATIONS:
Indeterminable fiscal implications to the State and local governments.
 
EFFECTIVE DATE:
This act shall take effect immediately; provided however, that sections
one, two, three, four, five and six of this act shall take effect on the
same date and in the same manner as a chapter of the laws of 2024 amend-
ing the family court act and the social services law relating to enact-
ing the "safe landings for youth leaving foster care act" or "safe land-
ings act", as proposed in legislative bills numbers S. 8724-B and A.
9321-B, takes effect.
