TITLE OF BILL:
An act to amend the state technology law and the civil service law, in
relation to the disclosure of automated employment decision-making tools
and maintaining an artificial intelligence inventory; to amend a chapter
of the laws of 2024 amending the state technology law relating to auto-
mated decision-making by state agencies, as proposed in legislative
bills numbers S. 7543-B and A. 9430-B, in relation to the effectiveness
thereof; to repeal sections 1 and 3 of a chapter of the laws of 2024
amending the state technology law relating to automated decision-making
by state agencies, as proposed in legislative bills numbers S. 7543-B
and A. 9430-B, in relation to the short title and disclosure; to repeal
sections 403 and 404 of the state technology law relating to impact
assessments and submission of certain reports; and providing for the
repeal of certain provisions upon expiration thereof
 
PURPOSE:
This is a chapter amendment to L.2024, C.674 to require state agencies
to publish detailed information about their automated decision-making
tools on their public websites. The Office of Information Technology
will create and maintain an inventory of all artificial intelligence
systems used by state agencies. Additionally, the legislation strength-
ens worker protections by explicitly preserving existing civil service
rights, ensuring these rights may not be diminished by AI systems.
 
SUMMARY OF PROVISIONS:
TThis legislation amends the underlying chapter by repealing provisions
that require impact assessments and meaningful human review. Instead, it
mandates agencies to disclose automated decision-making tools on their
websites and requires the Office of Information Technology to maintain
an inventory of state agency artificial intelligence systems in use.
Furthermore, the bill codifies labor protections for existing civil
service rights.

JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
 
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 674 of the Laws of 2024.- S.7543-B and
A.9430-B both passed the Senate and Assembly, respectfully, in June
2021.
 
FISCAL IMPLICATIONS:
None
 
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2024 amending the state technology law and the
civil service law, in relation to the disclosure of automated employment
decision-making tools and maintaining an artificial intelligence inven-
tory, as proposed in legislative bills numbers S.7543-B and A.9430-B,
takes effect.
