TITLE OF BILL:
An act to amend the public health law, in relation to organ donation
registration through a patient-facing portal; and to amend a chapter of
the laws of 2024 amending the public health law relating to allowing
patients to register in the "donate life registry" through their elec-
tronic health records, as proposed in legislative bills numbers S. 8456
and A. 7079, in relation to the effectiveness thereof
 
PURPOSE:
This is a chapter amendment that makes changes to provisions of L.2023,
c.662, to allow a patient to register in the Donate Life Registry
through their electronic health records
 
SUMMARY OF PROVISIONS:
This legislation amends the underlying chapter by requiring the regis-
tration to the Donate Life America (DLA) registry be through a patient-
facing portal of the electronic health record (EHR). The chapter also
requires that EHR products do not retain or store patient information to
protect patient confidentiality and prevent conflicts of interest that
can arise if the facility is aware of the patient's donor status prior
to the point the patient meets criteria for determination of suitability
for organ donation.
This legislation also amends the underlying chapter by requiring the EHR
products to meet standards set by the Department of Health, including
but not limited to using a standardized question that allows direct
enrollment in the Donate Life registry and required data elements.
Lastly, this legislation amends the underlying chapter by extending the
effective date to two years from enactment to provide more compliance
time for hospitals and vendors. The chapter also requires that any
registrations within 2 years of enactment be transmitted to the Donate
Life New York State (DLNYS) registry in addition to DLA.
 
JUSTIFICATION:
This legislation is a negotiated change to the underlying chapter.
 
LEGISLATIVE HISTORY:
Chapter amendment to Chapter 662 of the Laws of 2024. S.8456 and A.7079
passed the Senate and Assembly in March and May 2024, respectively.
 
FISCAL IMPLICATIONS:
None
 
EFFECTIVE DATE:
This act shall take effect immediately; provided that sections one, two
and three of this act shall take effect on the same date and in the same
manner as a chapter of the laws of 2024 amending the public health law
relating to allowing patients to register in the "donate life registry"
through their electronic health records, as proposed in legislative
bills numbers S. 8456 and A. 7079, takes effect.
